Abstract
Polskie przepisy regulujące dostęp do światła słonecznego do pomieszczeń mieszkalnych są niejednoznaczne i kontrowersyjne. Często przekładają się na złe rozwiązania przestrzenne. Zachodzi więc oczywiste pytanie, czy możliwe jest stworzenie systemu, który byłby pozbawiony wad. Wartościowe byłoby zatem przeanalizowanie, jak radzą sobie z tym zagadnieniem inne systemy prawne. Celem badania jest więc próba porównania sposobów rozstrzygania konfliktów między właścicielami nieruchomości o dostęp do światła słonecznego oraz refleksja nad problemami z jakimi wiążą się owe rozwiązania. Wiedza ta może posłużyć naprawieniu polskich przepisów oraz wskazać kierunki ewentualnych głębszych zmian.
Zaprezentowane w pracy wyniki powstały w skutek wnikliwych i złożonych analiz regulacji prawnych oraz innych materiałów źródłowych. Rozprawa została podzielona na 17 rozdziałów merytorycznych oraz bibliografię, zestawienie aktów prawnych, spis ilustracji i tabel oraz tłumaczenia najistotniejszych aktów prawnych różnych państw.
Porównanie aktów prawnych pozwoliło na sformułowanie wniosków i zaproponowanie skatalogowania przeanalizowanych rozwiązań prawnych z różnych krajów w pięć różnych typów modeli ochrony prawa dostępu do światła słonecznego w zabudowie mieszkaniowej.
Polish regulations governing access to sunlight to living quarters are ambiguous and controversial. They often translate into bad spatial solutions. So the obvious question is whether it is possible to create a system that is free from flaws. It would therefore be worthwhile to analyze how other legal systems deal with this issue. The aim of the study is therefore to try to compare the methods of resolving conflicts between property owners over access to sunlight and to reflect on the problems associated with these solutions. This knowledge can be used to correct Polish regulations and indicate the directions of possible deeper changes.
The results presented in the study were created as a result of in-depth and complex analyzes of legal regulations and other source materials. The dissertation was divided into 17 substantive chapters as well as a bibliography, a list of legal acts, a list of illustrations and tables, and translations of the most important legal acts of various countries.
The comparison of legal acts made it possible to formulate conclusions and propose a catalog of the analyzed legal solutions from different countries into five different types of models of protection of the right to access sunlight in residential buildings.
